Thanks! The way I'd put it is that Kavanaugh sort of tried to do that with language in a footnote in his concurrence to a case about IL and the National Guard.
This law professor (see link below) says he's "puzzled" by how to reconcile the two statements and I think that's why the whole thing is clear as mud.
